Our firm has handled numerous appeals for our own clients and the clients that have been referred to us. The person or entity taking an appeal is called an appellant. The person defending or against whom an appeal is taken is called a respondent.
Generally speaking, in most cases, the person or entity dissatisfied with a court order or decision has at least one appeal. For example, if after trial in the Supreme Court a person looses and is dissatisfied with that loss, that person can appeal to the Appellate Division of the Supreme Court. In District Court, appeals are taken to the Appellate Term. Appeals from the Appellate Term to the Appellate Division or from the Appellate Division to the Court of Appeals are not always automatically allowed. They are in certain circumstances; but in other circumstances permission from the higher court must be obtained in order to prosecute the appeal.
In federal court, District Court orders are appealled to the United States Circuit Court of Appeals.
